CUSTOMER’S LIABILITY REGARDING THE OWNERSHIP AND/OR LICENSE OF THE AUDIO MASTER AND IMAGE CONTENT
The content of the audio master transferred by Mr Vertigo Vinyl Records onto vinyl media, even in a single copy, is intended exclusively for personal or professional use (backup, archive, or collection) and may not be distributed publicly, either for free or for sale.
Mr Vertigo Vinyl Records shall not be held responsible for the content of the audio files and images provided by the customer.
If the materials delivered are protected, even partially, by copyright, the customer assumes full responsibility for any abuse or violation arising from their use after production.
The customer declares to own the rights of use and reproduction of the submitted materials and expressly releases and indemnifies Mr Vertigo Vinyl Records from any civil, administrative, or criminal liability arising from such content, undertaking to hold the company harmless from any third-party claims or demands for damages.
STORAGE OF AUDIO AND GRAPHIC MATERIAL:
Mr Vertigo Vinyl Records retains the audio and graphic files provided by the customer for 12 months from the order date. This period may be extended at the company’s discretion, exclusively for technical or backup purposes.
The files will be used only upon the request of their rightful owner and will not be shared with third parties, except when necessary for the execution of the requested services.
The customer may request the deletion of the files by sending an e-mail with the subject “FILE DELETION REQUEST.” Mr Vertigo Vinyl Records will proceed with deletion once the production process is completed.
The company may reproduce photographic or digital copies of the works for portfolio or promotional purposes, provided that the materials are not covered by confidentiality agreements or third-party copyrights.
Any excess printed graphics will be destroyed after production, unless otherwise requested by the customer. If not requested, the positive master will be stored for 12 months and then destroyed.
ADDITIONAL OR REDUCED PRODUCTION:
During vinyl pressing, a variation of up to ±10% in the ordered quantity may occur. This variation must be unconditionally accepted by the customer, and invoicing will be based on the actual production quantity.
ORDER VALIDITY:
The order is considered valid only after receipt of payment and upon submission of material that meets the required technical specifications.
PRIVACY AND HANDLING OF PERSONAL INFORMATION:
All data and materials provided will be used exclusively to process the order and for communications related to Mr Vertigo Vinyl Records’ services. Personal data will be processed in compliance with EU Regulation 2016/679 (GDPR) and will not be shared with third parties.
Mr Vertigo Vinyl Records reserves the right to display the works produced on its website or social media channels, unless the customer expressly objects.

SHIPPING AND DELIVERY:
Shipments are made at the customer’s risk and expense. Mr Vertigo Vinyl Records acts only as a shipping agent and shall not be held responsible for any damage or loss caused by the courier. Insured shipping is recommended. In the event of a damaged parcel, the customer must accept delivery “with reservation” and send detailed photos to Mr Vertigo Vinyl Records, keeping the packaging until verification.
For insured shipments that are lost or damaged, Mr Vertigo Vinyl Records may, at its sole discretion, reproduce the order or issue a full refund.
Mr Vertigo Vinyl Records will inform the customer of the shipping method, carrier, costs, and tracking code.
DAMAGED AND/OR DEFECTIVE PRODUCTS:
In case of damaged and/or defective article, the customer shall send, within 30 days of receipt, the photographic and/or audiovisual material showing the actual defect or damage. In addition there is the possibility that the customer will have to send at his own expense the article at the headquarters of Mr Vertigo Vinyl Records for the control and analysis of the defect or damage.
Mr Vertigo vinnyl Records will then notify you if the item is replaced/refunded partially or wholly.
PRODUCTION TIMES:
The indicated production times are approximate and may vary depending on workload and material availability. Any delays shall not constitute grounds for order cancellation or compensation claims.
RIGHT OF WITHDRAWAL
Pursuant to Article 59 of the Italian Consumer Code (Legislative Decree 206/2005), personalized products and services are excluded from the right of withdrawal.
By confirming the order, the customer acknowledges and accepts that, once production has started, no changes, cancellations, or refunds will be possible.
The terms and conditions described herein are unconditionally accepted by the customer at the time of order placement.
“Customer” refers to the individual or company requesting the services provided by Mr Vertigo Vinyl Records.
